On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, makes the order set out in the attached Appendix.

APPENDIX

Fisheries

1 The Ministry of Fisheries is established.

2 The duties, powers and functions of the Minister of Agriculture, Fisheries and Food and Ministry of Agriculture, Fisheries and Food in relation to

(a) the British Columbia Aquaculture Industry Advisory Council,

(b) the British Columbia Salmon Marketing Council,

(c) Fisheries Renewal BC, and

(d) British Columbia's commercial fisheries and aquaculture

are transferred to the Minister of Fisheries and Ministry of Fisheries respectively.

3 The Minister of Fisheries is charged with the administration of the Acts referred to in Schedule 1 to this Appendix and provisions in previous orders charging another member of the Executive Council with the administration of those Acts are rescinded.

4 The unexpended balance of money and other resources authorized for the administration of the duties, powers and functions referred to in section 2 of this Appendix or for the administration of Acts referred to in section 3 of this Appendix may be expended by the Minister of Fisheries and the Ministry of Fisheries.

Ministry renamed

5 The Ministry of Agriculture, Fisheries and Food is renamed the Ministry of Agriculture and Food.

Advanced Education, Training and Technology and
Minister of Intergovernmental Relations

6 The Ministry of Advanced Education, Training and Technology is established.

7 The duties, powers and functions of the Minister of Employment and Investment in relation to the Crown Corporations Secretariat and the Information, Science and Technology Agency are transferred to the Minister of Advanced Education, Training and Technology.

8 The duties, powers and functions of the Minister of Finance and Corporate Relations in relation to intergovernmental relations are transferred to the Minister of Intergovernmental Relations.

9 The duties, powers and functions of the Minister of Finance and Corporate Relations and the Ministry of Finance and Corporate Relations in relation to the Provincial Capital Commission are transferred to the Minister of Advanced Education, Training and Technology and Ministry of Advanced Education, Training and Technology respectively.

10 The duties, powers and functions of the Minister of Education, Skills and Training in relation to

(a) the Advanced Education Council,

(b) the Industry Training and Apprenticeship Commission, and

(c) the Private Post-Secondary Institutes Commission

are transferred to the Minister of Advanced Education, Training and Technology and Ministry of Advanced Education, Training and Technology respectively.

11 The Minister of Advanced Education, Training and Technology is charged with the administration of the Acts referred to in Schedule 2 to this Appendix and provisions in previous orders charging another member of the Executive Council with the administration of those Acts are rescinded.

12 The unexpended balance of money and other resources authorized for the administration of the duties, powers and functions referred to in sections 7, 8, 9 and 10 of this Appendix or for the administration of Acts referred to in section 11 of this Appendix may be expended by the Minister of Advanced Education, Training and Technology and Minister of Intergovernmental Relations and Ministry of Advanced Education, Training and Technology, as appropriate.

13 Where reference is made to the Minister of Education, Skills and Training in section 2 of the Industry, Training and Apprenticeship Act, the Minister of Advanced Education, Training and Technology is designated to be the official to whom reference shall be considered to be made.

Ministry renamed

14 The Ministry of Education, Skills and Training is renamed the Ministry of Education.

Employment and Investment

15 The duties, powers and functions of the Minister of Municipal Affairs and Housing in relation to

(a) housing,

(b) the BC Housing Management Commission, and

(c) the Provincial Rental Housing Commission

are transferred to the Minister of Employment and Investment and Minister Responsible for Housing.

16 The Minister of Employment and Investment is charged with the administration of

(a) the Insurance Corporation Act,

(b) the Insurance (Motor Vehicle) Act,

(c) sections 5 (c) and 10 of the Ministry of Lands, Parks and Housing Act, and

(d) the Shelter Aid for Elderly Renters Act

and all provisions in previous orders charging another member of the Executive Council with the administration of those Acts are rescinded.

17 The unexpended balance of money and other resources authorized for the administration of the duties, powers and functions referred to in section 15 of this Appendix or for the administration of Acts referred to in section 16 of this Appendix may be expended by the Minister of Employment and Investment.

Ministry renamed

18 The Ministry of Municipal Affairs and Housing is renamed the Ministry of Municipal Affairs.

Energy and Mines and Minister Responsible for Northern Development

19 The Ministry of Energy and Mines is established.

20 The duties, powers and functions of the Minister of Employment and Investment and the Ministry of Employment and Investment in relation to the Kemess Mine are transferred to the Minister of Energy and Mines and Minister Responsible for Northern Development and Ministry of Energy and Mines respectively.

21 The Minister of Energy and Mines and Minister Responsible for Northern Development is charged with the administration of the Acts referred to in Schedule 3 to this Appendix and provisions in previous orders charging another member of the Executive Council with the administration of those Acts are rescinded.

22 The unexpended balance of money and other resources authorized for the administration of the duties, powers and functions referred to in section 20 of the Appendix or for the administration of the Acts referred to in section 21 of this Appendix may be expended by the Minister of Energy and Mines and Minister Responsible for Northern Development and Ministry of Energy and Mines respectively.

Small Business, Tourism and Culture

23 The Minister of Small Business, Tourism and Culture is charged with the administration of the Liquor Distribution Act and provisions in previous orders charging another member of the Executive Council with the administration of this Act is rescinded.

24 The unexpended balance of money and other resources authorized for the administration of the Liquor Distribution Act may be expended by the Minister of Small Business, Tourism and Culture and Ministry of Small Business, Tourism and Culture respectively.

Finance and Corporate Relations

25 The duties, powers and functions of the Minister of Health and Minister Responsible for Seniors and the Ministry of Health in relation to Westcoast Express Ltd. are transferred to the Minister of Finance and Corporate Relations and Ministry of Finance and Corporate Relations respectively.

26 The Minister of Finance and Corporate Relations is charged with the administration of the British Columbia Transit Act and provisions in previous orders charging another member of the Executive Council with the administration of this Act are rescinded.

27 The unexpended balance of money and other resources authorized for the administration of the duties, powers and functions referred to in section 25 of this Appendix and for the administration of the British Columbia Transit Act may be expended by the Minister of Finance and Corporate Relations and Ministry of Finance and Corporate Relations respectively.
