ORDER IN COUNCIL 135

    •  (a) the transfers of duties, powers and functions and other changes set out in the Appendix to this order are made, 
•  (b) the Minister of Health Services is charged with the administration of the Health Sector Partnerships Agreement Act, S.B.C. 2003, c. 93,
•  (c) effective April 1, 2004, the Minister of Small Business and Economic Development is charged with the administration of (i) sections 8 and 9 of the Special Accounts Appropriation and Control Act, RS.B.C. 1996, c. 436, and (ii) the Arts Council Act, RS.B.C. 1996,c. 19,
•  (d) provisions in previous orders are rescinded insofar as these provisions (i) are inconsistent with a transfer or change made under paragraph (a) of this order, or (ii) charge another member of the Executive Council with responsibility for the administration of an enactment in a manner that conflicts with paragraph (b) or (c) of this order, and
•  (e) a transferor change under paragraph (a), or a transfer of administration under paragraph (b) or (c), of this order serves also to transfer to the member of the Executive Council the unexpended balance of money and other resources authorized for the administration of the duties, powers, functions and enactments involved.
 
APPENDIX
Community, Aboriginal and Women's Services
1.  The powers, duties and functions respecting the BC Olympic Games Secretariat, Sports and Culture are transferred to the Minister of Community, Aboriginal and Women's Services.
2. The Minister of Community, Aboriginal and Women's Services is designated as the official to whom the reference in section 9 (3) of the Special Accounts Appropriation and Control Act to the Minister of Community, Aboriginal and Women's Services is to be considered to be made.
 
Small Business and Economic Development
3. Effective April 1, 2004, the powers, duties and functions respecting the BC Olympic Games Secretariat, Sports and Culture are transferred to the Minister of Small Business and Economic Development.
4.  Effective April 1, 2004, the Minister of Small Business and Economic Development is designated as the official to whom the reference in section 9 (3) of the Special Accounts Appropriation and Control Act to the Minister of Community, Aboriginal and Women's Services is to be considered to be made.

1.  B.C. Reg. 134/2001 - the Government Reporting Entity Regulation is amended
(a)  by repealing section 1(b) and
(b)  by repealing section 2(e) to (g).
2. Transition
The amendments made to the Government Reporting Entity Regulation, B.C. Reg. 134/2001, by section 1 of this order first apply for the purposes of the 2004/2005 fiscal year.

section 1 of the Exemption Regulation, B.C. Reg. 27/2002, is amended
   (a)   in the list of exempted organizations by adding "Creston Valley Wildlife Management Authority" immediately below "Canadian Blood Services",
(b) in the list of exempted organizations, by striking out "BC Pavillion Corporation", "British Columbia Heritage Trust", "Fisheries Renewal BC" and "Forest Renewal BC",
(c) by renumbering the section as section 1 (1),
(d) and, by adding the following subsection: (2) British Columbia Railway Company and Organized Crime Agency of British Columbia are exempted from the application of section 13 [service plans] of the Budget Transparency and Accountability Act.
