Statutory Authority: Constitution
(a) all previous designations of officials pursuant to section 9 (2) of the Constitution Act are rescinded, (b) the designations in the Schedule to this order are made, and (c) the appointments of Parliamentary Secretaries in the Schedule to this order are made.

Ministry Responsible: Constitution
Statutory Authority: Premier
(a)   the transfers of duties, powers and functions, and other changes, set out in Appendix A to this order are made
(b) each member of the Executive Council listed in Appendix B is charged with the administration of the enactments specified in Appendix B for that member
(c) provisions in previous orders are rescinded insofar as these provisions
  (i)  are inconsistent with a transfer or change made under paragraph (a) of this order, or
  (ii)  charge another member of the Executive Council with responsibility for the administration of an enactment in a manner that conflicts with paragraph (b) of this order, and
(d) a transfer or change under paragraph (a), or a transfer of administration under paragraph (b), of this order serves also to transfer to the member of the Executive Council the unexpended balance of money and other resources authorized for the administration of the duties, powers, functions and enactments involved.
 

APPENDIX -- A

Premier
The duties, powers and functions of the Premier are continued.
The duties, powers and functions respecting Cabinet Operations are transferred to the Premier.
Aboriginal Relations and Reconciliation
The Ministry of Aboriginal Relations and Reconciliation is established.
The duties, powers and functions of the Attorney General and Minister Responsible for Treaty Negotiations respecting Negotiations, Negotiations Support and Treaty Settlement and Implementation Costs as described in section 11 of Appendix A of order in council 565/2001 are transferred to the Minister of Aboriginal Relations and Reconciliation.
The duties, powers and functions of the Minister of Community, Aboriginal and Women's Services under section 16 of Appendix A of order in council 565/ 2001 are transferred to the Minister of Aboriginal Relations and Reconciliation.
Advanced Education
The Ministry of Advanced Education is continued.
The duties, powers and functions respecting the BC Innovation Council are transferred to the Minister of Advanced Education and Minister Responsible for Research and Technology.
Agriculture and Lands
The Ministry of Agriculture, Food and Fisheries is renamed the Ministry of Agriculture and Lands.
The duties, powers and functions respecting Land and Water British Columbia Inc. are transferred to the Minister of Agriculture and Lands.
The duties, powers and functions respecting Land Information BC are transferred to the Minister of Agriculture and Lands.
Attorney General
The Ministry of Attorney General is continued.
The duties, powers and functions that were transferred to the Minister of Community, Aboriginal and Women's Services by section 17 of Appendix A of order in council 565/2001 are transferred to the Attorney General and Minister Responsible for Multiculturalism.
Children and Family Development
The Ministry of Children and Family Development is continued.
The duties, powers and functions relating to the Child Care Services Program are transferred to the Minister of Children and Family Development.
Community Services
The Ministry of Community, Aboriginal and Women's Services is renamed the Ministry of Community Services.
Economic Development
The Ministry of Small Business and Economic Development is renamed the Ministry of Economic Development.
The duties, powers and functions respecting the British Columbia 2010 Olympic and Paralympic Winter Games Secretariat that are not otherwise transferred by this order, are transferred to the Minister of Economic Development and the Minister Responsible for the Asia-Pacific Initiative and the Olympics.
The Minister of Economic Development and the Minister Responsible for the AsiaPacific Initiative and the Olympics is designated as the official to whom the reference in section 9 (3) of the Special Accounts Appropriation and Control Act to the Minister of Community, Aboriginal and Women's Services is considered to be made.
The duties, powers and functions respecting the Premier's Technology Council are transferred to the Minister of Economic Development and the Minister Responsible for the Asia-Pacific Initiative and the Olympics.
The duties, powers and functions respecting the B.C. Competition Council are transferred to the Minister of Economic Development and the Minister Responsible for the Asia-Pacific Initiative and the Olympics.
Education
The Ministry of Education is continued.
The duties, powers and functions of the Minister of Children and Family Development respecting the Early Childhood Development program are transferred to the Minister of Education and Minister Responsible for Early Learning and Literacy.
The duties, powers and function respecting the Premier's Advisory Council on Literacy are transferred to the Minister of Education.
Employment and Income Assistance
The Ministry of Human Resources is renamed the Ministry of Employment and Income Assistance.
Energy and Mines and Petroleum Resources
The Ministry of Energy and Mines is renamed the Ministry of Energy and Mines and Petroleum Resources.
Environment
The Ministry of Water, Land and Air Protection is renamed the Ministry of Environment.
The duties, powers and functions respecting the Environmental Assessment Office are transferred to the Minister of Environment and the Minister Responsible for Water Stewardship and Sustainable Communities.
A reference to the Minister of Water, Land and Air Protection in the definition of "ministers" in section 1 of the is deemed to be a reference to the Minister of Environment and the Minister Responsible for Water Stewardship and Sustainable Communities.
Finance
The Ministry of Finance is continued.
The duties, powers and functions respecting the Crown Agencies Secretariat and the Public Affairs Bureau are transferred to the Minister of Finance.
The duties, powers and functions respecting the BC Securities Commission are transferred to the Minister of Finance.
Forests
The Ministry of Forests is renamed the Ministry of Forests and Range. The duties, powers and functions respecting the BC Housing Management Commission are transferred to the Minister of Forests and Range and the Minister Responsible for Housing.
The duties, powers and functions respecting the Premier's Task Force on Homelessness are transferred to the Minister of Forests and Range and the Minister Responsible for Housing.
Health
The Ministry of Health Services is renamed the Ministry of Health.
The duties, powers and functions respecting the Ministry of Children and Family Development's responsibilities respecting youth mental health are transferred to the Minister of Health.
The duties, powers and functions relating to the Vital Statistics Special Operating Agency are transferred to the Minister of Health. A reference in the to the Minister of Health Services is deemed to be a reference to the Minister of Health.
Labour and Citizens' Services
The Ministry of Skills Development and Labour is renamed the Ministry of Labour and Citizens' Services.
The duties, powers and functions of the Minister of Management Services that are not transferred by this order to another minister or ministry are transferred to the Minister of Labour and Citizens' Services.
The duties, powers and functions respecting the Canada-British Columbia Business Service Centre are transferred to the Minister of Labour and Citizens' Services.
The duties, powers and functions respecting the Board Resourcing and Development Office in the Premier's Office are transferred to the Minister of Labour and Citizens' Services.
The duties, powers and functions respecting BC Internet Services, BC Bid, Solutions BC and Enquiry BC are transferred to the Minister of Labour and Citizens' Services.
Management Services
The Ministry of Management Services is disestablished.
Public Safety and Solicitor General
The Ministry of Public Safety and Solicitor General is continued.
Small Business and Revenue
The Ministry of Provincial Revenue is renamed the Ministry of Small Business and Revenue.
The duties, powers and functions respecting small business are transferred to the Minister of Small Business and Revenue and Minister Responsible for Deregulation.
The duties, powers and functions respecting the Regulatory Reform Office are transferred to the Minister of Small Business and Revenue and Minister Responsible for Deregulation.
Sustainable Resource Management
The Ministry of Sustainable Resource Management is disestablished.
Tourism, Sports and the Arts
The Ministry of Tourism, Sports and the Arts is established.
The duties, powers and functions respecting the film industry, tourism development, the Pacific Rim Institute of Tourism, the BC Arts Council and Tourism British Columbia are transferred to the Minister of Tourism, Sports and the Arts.
The duties, powers and functions respecting Pavco are transferred to the Minister of Tourism, Sports and the Arts.
The duties, powers and functions respecting the Olympic Arts Fund and the Physical Fitness and Amateur Sports Fund components of the British Columbia 2010 Olympic and Paralympic Winter Games Secretariat are transferred to the Minister of Tourism, Sports and the Arts.
The duties, powers and functions respecting the BC Film Commission are transferred to the Minister of Tourism, Sports and the Arts.
Transportation
The Ministry of Transportation is continued.
The duties, powers and functions respecting the Ministry of Public Safety and Solicitor General's responsibilities respecting commercial vehicle safety and inspections are transferred to the Minister of Transportation.
